Workplace Investigation Reports on Refusal to Work

Note to readers The entry into force, on October 31, 2014, of the changes made to Part II (Occupational Health and Safety) of the Canada Labour Code obliges an employer to produce a written investigation report for each refusal to work brought to attention of the employer. If the refusal is not resolved following the employer investigation, the Work Place Health and Safety Committee or Representative must conduct a separate, independent, investigation. Should the refusal not be resolved following these two internal investigations, the case must be reported to the Minister of Labour. Although the Code does not specify the format or content of these written reports, we suggest that you use the format proposed below.
